Penalty: $37,500
Pursuant to sections 72.02 of the Telecommunications Act, S.C. 1993, c. 38 (the Act), the undersigned has issued this Notice of Violation finding Northview Windows and Doors Inc. to have committed the following violations contrary to the Canadian Radio-television and Telecommunications Commission’s (CRTC’s) Unsolicited Telecommunications Rules (the Rules) made under section 41 of the Act:
Between 5 March 2013 and 30 September 2013, telemarketing telecommunications were made by Northview Windows and Doors Inc. to promote their services to the public. These telecommunications resulted in violations of Part II, section 4 of the Rules, for initiating telemarketing telecommunications to consumers’ telecommunications numbers that were registered on the National Do Not Call List (DNCL). These telecommunications also resulted in violations of Part II, section 6 for failing to subscribe to the National DNCL, Part II, section 13 for failing to use a version of the National DNCL obtained from the National DNCL Operator no more than 31 days prior to the date the telemarketing telecommunications were made and Part III, section 2 for failing to register with the and pay all applicable fees to the National DNCL Operator.
Pursuant to section 72.01 of the Act, the undersigned has determined that the total penalty for the violations identified above is $37,500.
The penalty of $37,500 must be paid by Northview Windows and Doors Inc. to “The Receiver General for Canada” in accordance with subsection 72.09(3) of the Act.
