Penalty: $200,000

Pursuant to section 72.07 of the Telecommunications Act, S.C. 1993, c. 38 (the Act), the undersigned has issued this notice of violation finding certain subsidiaries of 1051080 Ontario Inc. to have committed the following violations contrary to the Canadian Radio-television and Telecommunications Commission’s (CRTC’s) Unsolicited Telecommunications Rules (the Rules) made under section 41 of the Act:

Between 3 October 2011 and 25 June 2013, telemarketing telecommunications were made by certain subsidiaries of 1051080 Ontario Inc. to promote their services to the public. These telecommunications resulted in violations of Part II, subsection 4 of the Rules, for initiating telemarketing telecommunications to consumers’ telecommunications numbers that were registered on the National Do Not Call List (DNCL). These telecommunications also resulted in violations of Part III, subsections 10, 11 and 14 of the Rules, for failing to process and respect do not call requests from consumers, and further resulted in violations of Part III, subsection 29 of the Rules, for exceeding the permitted monthly abandonment rate.

Pursuant to section 72.01 of the Act, the undersigned has determined that the total penalty for the violations identified above is $200,000.

The penalty of $200,000 must be paid by 1051080 Ontario Inc. to “The Receiver General for Canada” in accordance with subsection 72.09(3) of the Act.
