RE: Application for costs award with respect to the participation of First Mile Connectivity Consortium in the inquiry initiated by Telecom Notice of Consultation CRTC 2014-44: Appointment of an Inquiry Officer to review matters related to transport services provided by satellite

Dear Mr. McMahon:

On 26 September 2014, First Mile Connectivity Consortium (FMCC) applied for costs with respect to its participation in the inquiry initiated by Telecom Notice of Consultation CRTC 2014-44, Appointment of an Inquiry Officer to review matters related to transport services provided by satellite.

The purpose of this letter is to request additional information relating to FMCC’s application for costs. FMCC is requested to provide the following information:

  1. Pursuant to section 66(1)(b) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules of Procedure)Footnote 1,an application for costs must identify the respondents that should pay the costs. Please indicate who FMCC considers the appropriate costs respondents to be.
  2. Pursuant to section 66(3) of the Rules of Procedure, a costs applicant must serve the application on all other parties. Please serve your application on the other parties to the inquiry and confirm in writing to the Commission that it has been so served.
  3. Section 70(2) of the Rules of Procedure requires that the total amount of costs awarded must not exceed the total amount of costs necessarily and reasonably incurred by the applicant.  Explain in detail how the expert witness fees for Heather E. Hudson were necessarily and reasonably incurred. For guidance, you may wish to refer to Telecom Regulatory Policy CRTC 2010-963 and in particular paragraphs 18-19 of the Guidelines for the Assessment of Costs, which are attached to that decision.
  4. Confirm whether or not GST/HST was charged for the services provided by Rob McMahon, Brian Beaton, Susan O’Donnell, and Heather E. Hudson.
  5. Confirm whether or not FMCC is entitled to a GST/HST rebate from the provincial and/or federal government.
    1. If FMCC is entitled to a GST/HST rebate, specify the amount of that rebate and explain on what basis FMCC is eligible for the rebate.

The requested information is to be filed with the Commission by 27 January 2015.  A copy of this letter and all related correspondence will be added to the public record of the proceeding.
