Re: Follow-up to Decision 2014-527 – Requests for Extensions for filing dates – Detailed Marketing Plan and Show Cause Proceeding

Dear Mr. Abbott:

Commission staff is writing in response to two letters received from Bell Canada and Bell Mobility (Bell) that requested extensions to filing dates set out in Decision 2014-527 (the Bell Deferral Account Decision) as follows:

  1. Detailed Marketing Plan – In a letter dated 17 November 2014, Bell requested that the filing date for the detailed marketing plan for its “Direct Marketing initiative” be extended from 8 December 2014 to 30 days after the Commission issues its decision resulting from the Show Cause Proceeding.
  2. Show Cause Proceeding – In a letter dated 5 December 2014, Bell requested that the filing date for submissions to the Show Cause Proceeding be extended from 8 December 2014 to 19 December 2014.

A.  Detailed Marketing Plan

Bell submitted that the extension to the filing date for the detailed marketing plan is necessary given that Bell will only have a complete picture of “what it is seeking to market through the Direct Marketing initiative and to whom” when the Show Cause decision is rendered.
Staff notes that the Show Cause Proceeding pertains to the appropriate use of all unallocated funds remaining in Bell’s accessibility deferral account. Staff considers Bell’s request for extension to be reasonable given that it will allow Bell to take into consideration the direct marketing of the additional products and services that would be approved by the Commission as a result of the Show Cause Proceeding. Accordingly, staff grants Bell’s request for extension.

The amended filing date for the detailed marketing plan is 30 days after the issuance of the Show Cause decision. A firm filing date will be published when the decision is issued.

B.  Show Cause Proceeding

Bell Canada submitted that an extension to the filing date for the Show Cause Proceeding is necessary due to the unavailability of critical resources. Given this situation and that a short extension period has been requested, staff grants Bell’s request to extend the filing date for the Show Cause Proceeding to 19 December 2014.

Accordingly, the dates for the Show Cause Proceeding as set out in the Bell Deferral Account Decision are amended as follows:

  1. Bell Canada is to file with the Commission its submission regarding the use of its unallocated deferral account funds in accordance with (i) the Commission’s preliminary view regarding the use of deferral funds outside Bell Canada’s operating territory in Ontario and Quebec, and (ii) the proposed initiatives set out above by 19 December 2014.
  2. Interested persons who wish to become parties to the show cause proceeding are to file with the Commission an intervention regarding Bell Canada’s submission and the Commission’s preliminary view by 2 February 2015.
  3. Bell Canada may file replies to interventions with the Commission by 13 February 2015.
