Re:  Tariff Notice #121 – Follow up to Telecom Decision 2014-389 – Support Structure Service

Dear Sir:

On 29 September 2014, the Commission received an application by CityWest Group of Companies (CityWest), under Tariff Notice 121 (TN121), in which the company proposed revisions to its Support Structure Service. The company submitted that its application was a Group A retail tariff filing as described inApproval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010, as amended from time to time, (Information Bulletin 2010-455).

Commission staff considers that the application does not meet the definition of a Group A retail tariff filing as described in Information Bulletin 2010-455 because it does not deal with services provided to retail customers, but with services that would be provided only to competitors. For efficiency, the Commission will process this application as a Competitor tariff filing rather than close the file and require the company to re-file it as a new application. Based on the requirements set out in Information Bulletin 2010-455, the Commission will treat the application as though the proposed effective date were 30 calendar days from the date of the application.

Accordingly, the application will follow the procedures described in Information Bulletin 2010‑455 for Competitor tariffs, which include the following deadlines:

Consequently, CityWest is not to implement its proposed tariff changes until a Commission order is issued to dispose of this application.
