RE: Review of wholesale mobile wireless services, Telecom Notice of Consultation 2014-761 – Requests to maintain the confidential treatment of certain information
By letter dated 3 July 2014, the Commission directed certain Canadian wireless carriers to provide, on the public record of the above-noted proceeding, information related to roaming, tower and site sharing and other wholesale wireless services (the Disclosure Ruling). This information was to be filed by 7 July 2014.
Bell Mobility Inc. (Bell Mobility), by letter dated 11 July 2014, filed an application to review, rescind and vary the Commission's Disclosure Ruling and to stay that ruling, requesting that the responses to requests for information Bell Mobility(CRTC)3Mar14-11(a) and (d) and Bell Mobility(CRTC)3Mar14-12(a) and (c) remain confidential. A significant amount of Bell Mobility’s rationale for non-disclosure provided in its application was filed in confidence with the Commission.
By letter dated 14 July 2014, Vaxination Informatique submitted that parties cannot meaningfully comment on Bell Mobility’s application since the company’s core arguments were filed in confidence. As a result, Vaxination Informatique suggested, among other things, that the Commission return Bell Mobility’s application.
TELUS Communications Company (TELUS) and NorthernTel, Limited Partnership (NorthernTel), by letters dated 14 July 2014 and 15 July 2014, respectively, filed their own applications to review and vary the Disclosure Ruling, and also designated portions of their applications as confidential.
Bell Mobility, TELUS, and NorthernTel are to show cause, by close of business on 25 July 2014,as to why the specific sections of the companies’ submissions, highlighted in blue in the company-specific attachment to this letter, should not be placed on the public record.
In addition, Commission staff notes that Bell Mobility is not seeking a variance or rescission of the Commission’s Disclosure Order with respect to responses to parts (b) and (c) of CRTC 3Mar14-11 and part (b) of CRTC 3Mar14-12. Accordingly, Bell Mobility is to file, by 25 July 2014 on the public record of this proceeding, responses to those portions of the Disclosure Order
A letter detailing further process regarding the applications will be issued shortly.
