Re: Cogeco Cable Tariff Notice 48 – Introduction of Item 502 ‒ Local Service Request (LSR) Rejection Charge

Dear Sir:

On 26 June 2014, the Commission received an application from Cogeco Cable Inc. (Cogeco), under Tariff Notice 48, in which the company proposed revisions to its Access Services Tariff in order to introduce a Local Service Request (LSR) Rejection Charge. Cogeco requested an effective date of 30 June 2014.

Commission staff notes that, according to Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008, this application should have been submitted as a Group B tariff filing. Commission staff also notes that according to Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin 2010-455, 5 July 2010, Group B filings must be filed with the Commission at least 15 calendar days before the proposed effective date. For efficiency, the Commission will process this application based on a revised calculation of the proposed effective date – that is, based on the date of the application plus 15 days.

However, Commission staff is continuing its analysis of the application. Consequently, this application, along with any associated subsequent revisions, will not be approved on an interim basis on the 15th calendar day following receipt. The Commission intends to dispose of this application, along with any associated subsequent revisions, within 45 business days of receipt of the filing.
