RE: Review of wholesale mobile wireless services, Telecom Notice of Consultation 2014-76[1] – Requests for disclosure of information designated as confidential
This letter addresses requests for disclosure of information designated as confidential in the proceeding initiated by Telecom Notice of Consultation 2014-76.
On 1 May 2014, the Consumers' Association of Canada, the Council of Senior Citizens' Organizations of British Columbia, the National Pensioners and Senior Citizens Federation and the Public Interest Advocacy Centre (collectively, PIAC et al.) filed a submission requesting disclosure of certain information for which confidentiality had been claimed in connection with Commission staff's information requests dated 3 March 2014.
On 5 May 2014, Union des consommateurs (UC) filed a letter supporting PIAC et al.'s requests and requested disclosure of additional information for which confidentiality had been claimed in connection with Commission staff's information requests.
The following companies filed responses to PIAC et al. and/or UC's requests for disclosure: Bell Mobility, KMTS, NorthernTel, and Télébec (collectively); Bragg Communications Inc., carrying on business as Eastlink (Eastlink); Brooke Telecom Co-operative Ltd.; Execulink Telecom Inc.; Hay Communications; Ice Wireless; Mornington Communications Cooperative Ltd.; MTS Inc. and Allstream Inc. (collectively); Quadro Communications Co-operative Inc.; Québecor Média Inc., on behalf of Vidéotron G.P. (Québecor); Rogers Communications (Rogers); Saskatchewan Telecommunications; Sogetel Mobilité inc.; TBaytel; Telus Communications Company, Wightman Telecom Ltd., and Globablive Wireless Management Corp., carrying on business as WIND Mobile.
Commission staff notes that requests for disclosure of information designated as confidential are addressed in light of sections 38 and 39 of the Telecommunications Act (the Act) and sections 30 and following of the CRTC Rules of Practice and Procedure (the Rules of Procedure). In evaluating a request, an assessment is made as to whether the information falls into a category of information that can be designated as confidential pursuant to section 39 of the Act. An assessment is then made as to whether there is any specific direct harm likely to result from the disclosure of the information in question and whether any such harm outweighs the public interest in disclosure. In making this evaluation, a number of factors are taken into consideration, including the degree of competition and the importance of disclosure of the information for the purpose of obtaining a fuller record. The factors considered are discussed in more detail in Procedures for filing confidential information and requesting its disclosure in Commission proceedings, Broadcasting and Telecom Information Bulletin CRTC 2010-961, 23 December 2010, as amended by Broadcasting and Telecom Information Bulletin CRTC 2010-961-1, 26 October 2012.
Having regard to the considerations set out above, unless otherwise expressly indicated, the Canadian wireless carriers identified in the distribution list are to file with the Commission, if applicable and if not already done so, all information to be provided pursuant to this letter as set out in Attachment 1 by 27 May 2014.
Parties are reminded that, if a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.

Canadian wireless carriers are to provide on the public record their wireless network coverage at the end of 2013 as follows: a) the percentage of population broken down by province/territory, as well as a list of communities, covered by Long Term Evolution (LTE), and b) the percentage of population broken down by province/territory, covered by all other technologies aggregated together (e.g. GSM, CDMA, UMTS, GPRS, EDGE, HSPA, HSPA+).
