RE: Northwestel Inc. Tariff Notice 904
Dear Sir:
On 4 February 2014, the Commission received an application by Northwestel Inc. (Northwestel) under Tariff Notice 904. Northwestel proposed to introduce General Tariff item 1735, Terrestrial ADSL and Cable Internet services, and item 1736 Terrestrial Enterprise Internet Services.
Paragraph 28(1)(a) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that the Commission may request parties to file information or documents where needed.
Northwestel is requested to provide comprehensive answers, including rationale and any supporting information, to the attached questions by 2 April 2014.

Request for information – Northwestel Tariff Notice 904
In Northwestel Inc. – Regulatory Framework, Modernization Plan, and related Matters, Telecom Regulatory Policy 2013-711, 18 December 2013 (TRP 2013-711), the Commission noted that, in Telecom Order 98-619, 23 June 1998 (Telecom Order 98-619), it forbore from regulating Northwestel’s retail Internet services with respect to sections 24 (in part), 25, 29, and 31 and subsections 27(1), 27(3) (in part), 27(5), and 27(6) of the Telecommunications Act.
In TRP 2013-711, the Commission found as a question of fact that Northwestel’s terrestrial retail Internet services were no longer subject to a level of competition sufficient to protect the interests of users of these services and that it was no longer appropriate to refrain from regulating Northwestel’s terrestrial retail Internet services. The Commission therefore directed Northwestel to, among other things, file tariffs for its terrestrial retail Internet services by 4 February 2014.
In its application, Northwestel proposed tariffs for its residential Internet, business Internet, I-Enterprise, I-Gate, I-Hotel, Hospitality Enterprise Service, and Public Enterprise services.
In Telecom Order 98-619, the Commission indicated that the services under consideration included dial-up Internet service, future enhancements, and the company’s planned dedicated Internet services. However, Northwestel did not propose any tariffs for dial-up Internet services.
1. Confirm that Northwestel provides dial-up Internet services. If so, explain, with supporting rationale, whether it would be appropriate for Northwestel to include such services in its tariffs. If Northwestel concludes that it would be appropriate to include dial-up Internet services in its tariff, it should amend its application by 2 April 2014 to include such service.
2. Confirm that Northwestel’s proposed tariff items include all of its terrestrial retail Internet services other than dial-up Internet services. If not, the company should amend the application by 2 April 2014 to also include any missing services.
