RE: Videotron G.P. – Tariff Notices 48 and 48A – Request for disclosure of information

Dear Sir:

On 6 February 2014, the Commission received a letter from the Canadian Network Operators Consortium Inc. (CNOC) requesting that Videotron G.P. (Videotron) disclose information regarding the costs associated with Tariff Notices 48 and 48A. Specifically, the CNOC requested that certain information filed in confidence by Videotron in the report on the economic evaluation in support of its application be added to the public record. The CNOC submitted that disclosure of the information requested is required under Telecom Regulatory Policy CRTC 2012-592 (TRP 2012-592) and the directives contained in a Commission staff letter dated 13 September 2013, titled Information to be provided in support of wholesale service tariff applications.

On 21 February 2014, the Commission received Videotron’s response to the CNOC’s request.

Commission staff notes that, in TRP 2012-592, the Commission established disclosure guidelines for cost information filed in support of wholesale services, at the time of filing or when the information is filed in response to a request for information.

Further, Commission staff notes that, in accordance with the detailed directives set out in the Commission staff letter dated 13 September 2013, the applicant is not required to include the following detailed information in support of a tariff application for a wholesale service:
i) detailed information for key cost categories whose cost is less than 20% of the total service cost, or
ii) detailed information for “other” cost categories whose cost is equal to or higher than 10% of the total service cost.
Commission staff considers that the confidential designation of the cost information that Videotron filed in support of its application is compliant with the disclosure requirements set out in TRP 2012-592.
Commission staff is continuing its analysis of the application and expects to require Videotron to file additional information. That information will also be subject to the guidelines set out in TRP 2012-592 regarding confidential designation.
