Re: Execulink Telecom Inc. Tariff Notice No. 72, 72A, 72B and 72C – Revision of Direct Connect (DC) Service

Dear Sir/Madam:

Telecom Regulatory Policy CRTC 2013-160, Regulatory framework for the small incumbent local exchange carriers and related matters (TRP 2013-160) directed each small incumbent local exchange carrier to file revised tariff pages for their respective Direct Connect (DC) services, either reflecting the Telus Quebec DC rate, or supporting the proposed DC rate by a cost study.

On 2 August 2013, Execulink Telecom Inc. (Execulink) filed Tariff Notice (TN) 72 to revise Execulink's rate for DC service.

The company undertook a review of the cost study and filed revisions to its initial submission as TN 72A, further amended as TN 72B and TN 72C.

Bell Aliant, Bell Canada, DMTS, KMTS and NorthernTel (collectively, the Companies), Telus Communication Company, Allstream Inc. and Tbaytel (collectively, the interveners) filed their comments on TN 72 and the subsequent updates. The interveners identified a number of deficiencies associated with Execulink's DC cost study and requested the Commission to open up the process associated with TN 72 to an interrogatory round where clarifications on the Execulink cost study could be sought by both external parties and the Commission.

The Commission also received an intervention from the Canadian Independent Telephone Company Joint Task Force (JTF) stating that the cost study filed by Execulink with TN 72 C fully complies with accepted prospective incremental cost costing concepts, methods and assumptions, and that it should be approved by the Commission.

In light of the comments received from the interveners, it is appropriate to conduct a review of cost study assumptions and inputs within the following process:

Process

The Commission and the parties may address interrogatories to Execulink regarding their submissions. Any such interrogatories must be filed with the Commission and served on the relevant party or parties by 11 March 2014.

Responses to interrogatories are to be filed with the Commission and served on all parties by 25 March 2014.

Requests by parties for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on all parties by 28 March 2014.

Responses to interrogatories and disclosure of information are to be filed with the Commission by Execulink and served on all parties by 4 April 2014.

All parties may file written comments with the Commission on Execulink’s interrogatory responses, serving copies on all other parties, by 11 April 2014.

Execulink may file reply comments with the Commission, serving copies on all other parties, by 22 April 2014.
