Re: Cogeco Cable Inc. Tariff Notices 37 and 37A – Extension of process deadlines

Dear Sirs:

On 10 February 2014, the Commission received a letter from Canadian Network Operators Consortium Inc. (CNOC) requesting that Cogeco Cable Inc. (Cogeco) disclose costing information pertaining to Cogeco’s Tariff Notices 37 and 37A. In that letter, CNOC requested an extension to the date for the filing of its intervention with respect to Cogeco’s application. CNOC requested that it be able to file its intervention 15 days following the day that Cogeco has disclosed all the required information.

The Commission is also in receipt of a letter, dated 10 February 2014, from Cogeco, in which Cogeco submitted that its regulatory resources are currently fully deployed on other projects or temporarily unavailable. Cogeco requested that the Commission modify the procedures enunciated in its 20 December 2013 letter as follows: 1) Cogeco is to
reply to CNOC request for further responses and disclosure by 28 March 2014; 2) CNOC is to file its interventions by 14 April 2014, and 3) Cogeco is to file reply comments with the Commission, serving copies on all other parties, by 24 April 2014.

In the circumstances, Commission staff considers Cogeco’s proposal to be reasonable. Accordingly, Commission staff modifies the process deadlines as follows:

1) Cogeco is to reply to CNOC request for further responses and disclosure by 28 March 2014;
2) CNOC is to file its interventions by 14 April 2014 (consistent with Commission staff letter dated 13 February 2014), and
3) Cogeco is to file reply comments with the Commission, serving copies on all other parties, by 24 April 2014.
