Re: Part 1 Application by the Canadian Network Operators Consortium Inc. requesting relief to improve the quality of wholesale high-speed access services provided by cable carriers to independent service providers – CNOC comments
Dear Mr. Sandiford:
On 24 and 25 January 2014, Canadian Network Operators Consortium Inc. (CNOC) filed letters indicating its intention to respond to comments made by Quebecor Media on behalf of its affiliate Videotron G.P. dated 22 January 2014, Rogers Communications Partnership dated 23 January 2014, and by Shaw Communications Inc. (collectively, the cable carriers) dated 24 January 2014, with regard to CNOC’s reply in the above-noted proceeding. CNOC indicated that its regulatory resources were fully engaged in preparing its initial intervention in another proceeding, namely Review of wholesale services and associated policies, Telecom Notice of Consultation CRTC 2013-551, due on 31 January 2014, and that it would provide a response to the cable carriers’ comments in this proceeding shortly thereafter.
By letter dated 28 January 2014, CNOC was notified by Commission staff that its supplementary reply comments were to be filed by 7 February 2014 and that these reply comments were to be restricted to the comments submitted by the cable carriers on the dates noted above.
On 5 February 2014, CNOC requested an extension to 14 February 2014 to file its supplementary reply comments. CNOC indicated that this extension is needed because allegations and requests made in the Cable Carrier submissions require CNOC to obtain additional data and clarification from certain CNOC members. Further, CNOC reiterated that its regulatory resources had been involved in another proceeding as noted above.
Given the circumstances, the requested extension is considered reasonable. CNOC is reminded that its reply comments must respect subsection 27(2) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure. CNOC’s supplementary reply comments must be restricted to the points raised in the comments submitted by the cable carriers on 22 to 24 January 2014.
