Re Request to have access to the confidential version of Appendix 4 (Financial operations) – Application 2014-0793-2 - Broadcasting Notice of Consultation CRTC 2014-541, 2014-541-1 and 2014-541-2

This is in response to the Forum for Research and Policy in Communications’ (FRPC) request to have access to the confidential version of Appendix 4 (financial operations) submitted by Rogers Sportsnet Inc. (Rogers) in the above-noted application. Commission staff notes that the FRPC opposed Rogers’ request for confidential treatment of Appendix 4 as indicated at paragraph 75 of its intervention.

In its application, Rogers requested confidential treatment of the projected financial information contained in Appendix 4 given that, first, the Commission granted confidentiality to this information when it was filed as an undertaking in the licence renewal hearing held in April 2014 and, second, that it relates exclusively to a particular program. It argued that the disclosure of the projected financial information contained in Appendix 4 would be prejudicial to its competitive position.

As set out in the appendix to Procedures for filing confidential information and requesting its disclosure in Commission proceedings, Broadcasting and Telecom Information Bulletin CRTC 2010-961, the Commission grants confidential treatment to programming costs for individual radio and television programs or series. Commission staff notes that the financial information contained in Appendix 4 relates exclusively to the revenues and expenditures of the program “Hockey Night in Canada” broadcast on the Canadian Broadcasting Corporation, which is the only program that will be broadcast by the proposed television network. Accordingly, Commission staff considers it appropriate to grant confidential treatment to the financial information contained in Appendix 4.
