This is in reference to Rogers Communications Partnership’s (Rogers) letter dated 26 August 2014 seeking the Commission’s approval of its revised internal policy on the acquisition, promotion and distribution of adult programming for its video-on-demand (VOD) and pay-per-view (PPV) services, pursuant to the Revised regulatory framework for pay-per-view services, Broadcasting Regulatory Policy CRTC 2013-561 (Broadcasting Regulatory Policy 2013-561).

The Commission notes that the changes made to Rogers’ internal policy on adult programming (internal policy) are limited to the addition of references to its PPV service known as Rogers Sportsnet PPV, which did not previously offer adult programming. However, Rogers indicated in its letter that it intended to commence offering such programming on its PPV service effective 1 October 2014.

Pursuant to Broadcasting Regulatory Policy 2013-561, the Commission expects all licensees that intend to broadcast adult programming to file and seek approval of an internal policy prior to the implementation of the service and, subsequently, to seek approval of any amendments to their internal policy prior to their implementation.

The Commission has reviewed the revised internal policy on adult programming submitted by Rogers and notes that it is consistent with the Industry code of programming standards and practices governing pay, pay-per-view and video-on-demand services, Broadcasting Public Notice CRTC 2003-10, which contains detailed guidelines with respect to the broadcast of adult programming.

In light of the above, the Commission approves the revised internal policy.

In addition, the Commission expects the licensee to seek the Commission approval for any subsequent changes to the internal policy prior to their implementation.

The Commission’s files will be updated and will reflect the information stipulated in this letter of approval.

All letters of approval issued by the Commission are made available upon request for public examination at the Commission's central and regional offices.
