Re : Follow-up to Broadcasting Decision 2014-204

In Terrestrial broadcasting distribution undertakings serving various communities in New Brunswick and in Newfoundland and Labrador – Licence amendments, Broadcasting Decision 2014-204, the Commission approved an application by Rogers Communications Partnership to amalgamate several of its broadcasting distribution undertaking (BDU) into a smaller number of BDUs based on the existing zones established by the Commission for the provision of community television stations in New Brunswick and Newfoundland.

The following letter intends to clarify two outstanding issues that have arisen since the publication of the above-noted decision. First, where the decision refers to Rogers Communications Partnership, the decision should have referred more specifically to Mountain Cablevision Limited and Fido Solutions Inc., partners in a general partnership carrying on business as Rogers Communications Partnership (Rogers).

Second, while the decision refers to the amalgamation by Rogers of 43 of the 44 existing BDU licences into 7 BDU licences, we wish to clarify that the Commission actually granted the authority to amalgamate 43 of the 44 BDUs located in New Brunswick and Newfoundland and Labrador into 7 BDUs, for a total of 8 BDUs, all of which continue to operate under 1 regional licence.

We note that this regional licence will expire on 31 August 2015. Any future application filed by Rogers for this regional licence will be examined by the Commission in light of its current structure as clarified by this letter.
