Re Response to Applicant's undertakings, BNOC 2014-26
Ms. Wheeler:
This letter relates to the procedural request submitted to the Commission by Unifor on 22 April 2014. In its request, Unifor express its opposition with respect to the fact that the applicants were permitted to modify their requests for regulatory reliefs during the course of the hearing and in particular during their reply submissions. Unifor is of the view that the amendments submitted by the applicants constitute an improper reply as described in section 40(d) of the Commission's Rules of Practice and Procedure.
For that reason, it requests, amongst other things, that the Commission reconvene the hearings to clarify and discuss the impact of the applicants' abridged financial filings for the City stations. Unifor also mentions that it was advised by the applicants that the program expenditure figures filed in response to its undertakings may be in error.
Considering the extent of Unifor's procedural request and the overall content of the letter, Commission staff request that the applicants respond to Unifor's letter either as part of its final reply or in a separate letter by no later than 30 April 2014.
