Subject: Decision-making process for the MYtv application (2013-1216-5)

Dear Ms. Tabet:

This is a follow-up to the application by Québecor Média inc. (Québecor Média) on behalf of Vidéotron s.e.n.c. (Vidéotron) to modify Vidéotron’s conditions of licence to allow it to allocate up to 2% of its Canadian programming contribution to a new English-language community channel, which would be called MYtv (application 2013-1216-5).

In a letter to the Commission dated 12 February 2014, Vidéotron stated that it was concerned about the decision-making process for this application.

Staff duly notes the operational implications that Commission decisions may have when it handles this type of application. However, Staff considers that the circumstances surrounding Vidéotron’s application are substantially different from those which led to Broadcasting Decisions CRTC 2004-170 and 2013-623. For example, in this case, the Commission was made aware of a potential non-compliance. As stipulated in its letter of 6 February 2014, the Commission is of the view that the complaint by Télévision communautaire indépendante (TVCI) could have a direct impact on Vidéotron’s application. It is therefore in the interest of the Commission and the public that these files be handled at the same time, with a view to making the most informed decision possible.

We also note that, on 25 February 2014, the Commission received a letter from TVCI confirming that it had filed a complaint and asking that the complaint be dealt with under Part 1 of the CRTC Rules of Practice and Procedure (application 2013-1746-2). If this complaint is founded and Vidéotron is not meeting its obligations with regard to its community channel (MaTV), the Commission’s conclusions may have an impact on Vidéotron’s application for authorization to launch an English-language community television channel (MYtv).
