Subject: Part 1 applications 2014-0008-5 and 2014-0009-3 concerning TVI and RBTI

Dear Mr. Levin:

Thank you for providing the requested program grids and audio-visual recording of TVI’s and RBTI’s programming.

Based solely on the information provided, it appears to Commission staff, that TVI and RBTI do not meet the Canadian content requirements of section 4(d) set out in Appendix 2 of the New exemption order respecting certain programming undertakings that would otherwise be eligible to be operated as Category B services, and amendments to the Exemption order respecting certain third-language television undertakings (Broadcasting Order 2012-689), which states that not less than 15% of all programs broadcast by an exempt service during a calendar week must qualify as Canadian programs in accordance with the criteria established by the Commission in Certification for Canadian programs – A revised approach, Public Notice 2000-42.

It is noted that, based on the program grids provided, assuming the programs listed as Canadian content meet the criteria, the percentage of Canadian content broadcast during the relevant calendar weeks are the following:

Commission staff has also viewed the audio-visual recordings of TVI’s and RBTI’s programming for the week of 5 January 2014 to 11 January 2014. It appears that the program Ethnic Channels Group presents identified as in-house production is not a news or public affairs program. As such, staff notes that, in accordance with Certification for Canadian programs – A revised approach, Public Notice 2000-42, although the program would not require certification, it is not automatically considered Canadian content. To be considered as such Ethnic Channels Group must demonstrate that the program meets the criteria listed in Public Notice 2000-42. It may do so as part of its intervention during the comment period set out below.

Considering this new information, the new deadline for the submission of interventions and answers is 17 February 2014. The applicant may file a reply with the Commission on or before 27 February 2014.
