Re: Broadcasting Decision 2013-458, Dufferin Communications Inc. CIRR-FM

Dear Ms. Laurignano:

This is in reference to your letter dated 26 September 2013 in which Dufferin Communications Inc. filed with the Commission the following items in relation to radio station CIRR-FM, pursuant to Broadcasting Decision CRTC 2013-458:

a. code of ethics;
b. programming policies and processes regarding the broadcast of adult content at times when children could be listening;
c. Advisory Board processes for vetting content and preventing inappropriate content from being aired; and
d. complaint-resolution process.

Decision 2013-458 addressed a complaint pertaining to unduly sexually explicit material that was aired at a time when children could be expected to be listening and concerns regarding CIRR-FM’s interpretation of the type of material that is appropriate for broadcast over public airwaves and the Commission directed the filing of this information. The Commission also encouraged CIRR-FM to become a member of the Canadian Broadcast Standards Council (CBSC), the self-regulatory body whose objectives include encouraging high standards of professional conduct on the part of its members by ensuring that social concerns and values are reflected in their programming decisions.

Commission staff has reviewed all of the material filed by CIRR-FM and notes that CIRR-FM has become a member of the CBSC, plans to actively promote its CBSC membership, and proposes to augment its Advisory Board with an Ombudsman role for addressing listener complaints.

Given the actions taken by CIRR-FM with respect to joining the CBSC and creating the Ombudsman role, Commission staff considers that no further action in this matter is required at this time.
