Subject: Part 1 applications 2014-0008-5 and 2014-0009-3 concerning TVI and RBTI
Dear Mr. Levin:
In a letter dated 31 December 2013, the Commission received two complaints by 1395047 Ontario Inc., licensee of the third-language Category B service Festival Portuguese Television, regarding the programming of services operating as RBTI and TVI. This letter was posted on the Commission’s website as a Part 1 application on 14 January 2014.
The application concerns whether RBTI and TVI comply with section 4(d) of the exemption order set out in Appendix 2 of the New exemption order respecting certain programming undertakings that would otherwise be eligible to be operated as Category B services, and amendments to the Exemption order respecting certain third-language television undertakings (Third-language Exemption Order) CRTC 2012-689 which states that not less than 15% of all programs broadcast by an exempt service must qualify as Canadian programs in accordance with the criteria established by the Commission in Certification for Canadian programs – A revised approach, Public Notice 2000-42.
In order to ensure a complete record of the issues raised in this application, and pursuant to section 11 of the Third-language Exemption Order, please submit the following information:
1. A program grid for the calendar weeks of 1 December to 7 December 2013 and of 15 December to 21 December 2013 for each of the two services identified above. In these program grids, please provide the country of origin and where a program is Canadian, the certification number or CAVCO number for each program.
2. The audio-visual record of all programming on the two services identified above, as required to be maintained by section 10 of the Third Language Exemption Order, for the calendar week of 5 January to 11 January 2014.
3. A program grid, with the same information listed above, for the calendar week of 5 January to 11 January 2014.
Commission staff will analyse the information provided by Ethnic Channels Group in response to this letter and will publish their findings on the public record of this proceeding. Further process to respond to this analysis will be established at that time.
Please file the requested material by no later than 24 January 2014, serving the applicant. Please note that this letter and any subsequent correspondence will be added to the public records of the above-noted Part 1 proceedings.
