Northwestel Inc. - Fibre Loop Service
- The Commission received an application from Northwestel Inc. (Northwestel), dated 7 August 2014, in which the company proposed to revise its Special Services Tariff to introduce item 766 - Fibre Loop Service.
- Northwestel submitted that through this service, it provides a customer with a fibre loop in Whitehorse, Yukon. The company submitted that it has been providing the service to the customer since 2 December 2013 but, inadvertently, had not requested approval of a tariff from the Commission at the time it first offered the service. Northwestel further submitted that it had discovered the contract in its ongoing review of its services in response to Telecom Regulatory Policy 2013-711. It therefore requested ratification with respect to the charging of the rates for the service since 2 December 2013.
- In Telecom Order 2014-452, the Commission approved Northwestel’s application on an interim basis, effective 2 September 2014.
- The Commission received no interventions with respect to this application. The public record of this proceeding, which closed on 8 September 2014, is available on the Commission’s website at www.crtc.gc.ca or by using the file number provided above.
- The Commission notes that, pursuant to subsection 25(4) of the Telecommunications Act, it may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if it is satisfied that the rate was charged because of an error or other circumstance that warrants the ratification.
- The Commission notes Northwestel’s submission that it had inadvertently failed to file a tariff for Commission approval and that, therefore, it has been providing the service without an approved tariff. The Commission is satisfied that Northwestel provided Fibre Loop Service without an approved tariff in error. Under the circumstances, the Commission considers that the company’s request for ratification of the charging of the rate is reasonable.
- Accordingly, the Commission approves on a final basis Northwestel’s application. The Commission also ratifies Northwestel’s charging of the rate for its Fibre Loop Service from 2 December 2013 to 1 September 2014.
