NorthernTel, Limited Partnership – Intercommunicating Channels with Automatic or Manual Signalling service rate

- The Commission received an application from NorthernTel Limited Partnership (NorthernTel), dated 11 March 2014, in which the company proposed revisions to Section 810, item 2.01 (c) – Intercommunicating Channels with Automatic or Manual Signalling (ICAMS) of its General Tariff. Specifically, NorthernTel proposed to add a missing monthly rate for the ICAMS service. The company indicated that there was currently no rate in the referenced tariff item, Section N260, item 3.03.
- NorthernTel submitted that it did not have historical tariff pages that would help it identify when this rate may have been erroneously omitted. However, NorthernTel submitted that there had been no change in this rate for at least 10 years. NorthernTel therefore requested ratification for the charging of the rate for its ICAMS service other than in accordance with an approved tariff, pursuant to subsection 25(4) of the Telecommunications Act (the Act), so that customers could continue to benefit from the service.
- In Telecom Order 2014-149, the Commission approved NorthernTel’s application on an interim basis.
- The Commission received no interventions with respect to NorthernTel’s application. The public record of this proceeding, which closed on 26 March 2014, can be found on the Commission’s website at www.crtc.gc.ca or by using the file number provided above.
- The Commission notes that, pursuant to subsection 25(4) of the Act, it may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if it is satisfied that the rate was charged because of an error or other circumstance that warrants the ratification.
- The Commission is satisfied that NorthernTel provided its ICAMS service without an approved tariff due to an administrative error. In the circumstances, the Commission finds that the company’s rate ratification request is reasonable. The Commission considers that since it is unknown when the rate may have been removed, it would be appropriate to ratify the rate starting from the date on which it was first introduced. The Commission notes that the rate was first approved in Telecom Order 95-36.
- Accordingly, the Commission approves on a final basis NorthernTel’s application. The Commission also ratifies the charging of the rate by NorthernTel for its ICAMS service, from 13 January 1995 to 26 March 2014. NorthernTel is to issue revised tariff pagesFootnote 1 within 10 days of the date of this order.
