RE: Tariff Notice No. 464, Support Structure Service tariff (Item 404) from General Tariff (CRTC 21461)

Dear Mr. Reirson:

On 17 October 2013 the Commission received a request by TELUS Communications Company (TCC) to revise its Support Structure Service tariff (Item 404), General Tariff (CRTC 21461), to introduce a one-time service charge to recover a portion of the audit costs for service poles. The proposed service charge would be applied per licensee when a licensee is identified as being attached to one of the Company’s service poles during the service pole audit.

On 23 October 2013 the Commission received a Part 1 application from Shaw Communications Inc. (Shaw) requesting that the Commission direct TCC to adhere to the timing and transparency obligations in Order 2013-144, which established the process to determine the number of service poles in use by licensees in Bell Aliant Regional Communications, Limited Partnership, Bell Canada, and Télébec, Limited Partership’s serving territories.

In light of this, Commission staff considers that it is best to suspend the process related to the TCC application pending the treatment of the Part 1 application submitted by Shaw. Parties are therefore not required to file comments on the TCC application at this time.
