Re: Tariff Notice (TN) 41 from Cogeco Cable Inc – Introduction of a service condition for 10 GigE interfaces

Dear Mr. Sandiford:

The Canadian Network Operators Consortium Inc. (CNOC) commented on Cogeco Cable Inc. TN 41 which it proposed an amendment to its third party Internet access (TPIA) Tariff by introducing a service condition that would require TPIA customer to order and maintain 3 Gigabit per second capacity on 10 Gigabit Ethernet (GigE) port interfaces.

Commission staff has determined that additional information is required to complete its assessment of this application. Commission staff is thus requesting that CNOC submits responses to the attached interrogatories by 27 November 2013.

All parties may file written comments to the Commission by 4 December 2013. CNOC may file reply comments by 11 December 2013.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date. Copies of the documents should also be sent to abderrahman.elfatihi@crtc.gc.ca .

1. Refer to the Cogeco comment in response to CNOC’s intervention, dated 26 September 2013, where the company, in paragraph 6, stated that:

In fact the flexibility of 1 or 10 GigE interface ports is what makes for an efficient and economical service. Cogeco notes that many of its TPIA customers load balance multiple 2/3 full GigE ports for some degree of resiliency which is well supported by the model. It does without saying that obtaining a 10 GigE transport link is also much more expensive and the TPIA customer customers would likely also need to pay a premium to reserve that capacity of end to end transport.
a) Comment on the statement above.

b) From the perspective of CNOC’s members, what are the issues that should be taken into consideration when considering to upgrade from 1 GigE to 10 GigE Interface (e.g., costs, contract commitment, …).
