Re: Part 1 Application by the Canadian Network Operators Consortium Inc. requesting relief to improve the quality of wholesale high-speed access services provided by cable carriers to independent internet service providers – Request for extension

Dear Sirs:

On 7 October 2013, the Commission received a request by Cogeco Cable Inc., Quebecor Media Inc., on behalf of its affiliate Videotron G.P., Rogers Communications Partnership, and Shaw Cablesystems G.P. (collectively, the cable carriers) for a 30-day extension to the filing date for intervener comments on the above-noted Part 1 Application (application) filed by the Canadian Network Operators Consortium Inc. (CNOC) on 27 September 2013.

The cable carriers submitted that investigating and responding to the orders sought and the allegations raised in CNOC’s application requires the cable carriers to engage many different internal teams associated with providing TPIA services. The cable carriers also submitted that CNOC’s application proposes significant policy changes, raising additional complicated operational and regulatory issues. In addition, the cable carriers noted that the time period for preparing the comments on the application further coincides with the scheduled public hearing pursuant to Telecom Notice of Consultation CRTC 2013-155, Issues related to the feasibility of establishing a video relay service. In this regard, the cable carriers submitted that some of the cable carriers’ resources that are preparing for this hearing will also be preparing the comments on CNOC’s application.

In light of the circumstances, Commission staff considers the cable carriers’ request for a 30 day extension for the filing of comments on CNOC’s application to be reasonable. Accordingly, the cable carriers may file their comments by 29 November 2013, and CNOC may file its reply comments by 9 December 2013.

Consistent with the guidelines set out in Broadcasting and Telecom Information Bulletin CRTC 2010-959, copies of comments and reply comments referred to above are to be served on all parties to this proceeding. Copies of the documents should also be sent to pamela.cormier@crtc.gc.ca.
