Re: Application by Sasktel for an extension to implement the Wireless Code

Dear Mr. Hersche,

This is in reference to the application by Saskatchewan Telecommunications (Sasktel) for an extension to implement certain elements of Telecom Regulatory Policy 2013-271 (the Wireless Code or the Code).

Commission staff has reviewed Sasktel’s application and determined that additional information is required. Accordingly, Sasktel is to its file responses to the request for additional information attached to this letter by 19 August 2013, copying all parties. In light of this request, Commission staff considers that interveners could benefit from additional time in order to comment on Sasktel’s application. The deadline to submit comments is therefore extended to 26 August 2013. Reply comments will be due no later than 3 September 2013.

As set out in Broadcasting and Telecom Information Bulletin 2010-961, Sasktel may designate certain information as confidential. Sasktel must provide an abridged version of the document involved, accompanied by a detailed rationale to explain why the disclosure of the information is not in the public interest.

All submissions are to be made in accordance with the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure, SOR/2010-277.

Appendix – Request for Information

1) Refer to paragraph 364 of the Wireless Code:

“...the Commission considers that a WSP would be required to provide detailed evidence and rationale that show that their circumstances are unique and that the burden they face is exceptionally unreasonable.”

Commission staff notes that Sasktel’s application does not provide detailed evidence on the burden of compliance with the Code’s provisions. Please file a detailed cost study or provide rationale for Sasktel’s decision not to include this evidence.

2) Refer to paragraph 8 of Sasktel’s application.

a) In the event Sasktel’s application is denied, explain how Sasktel would comply with the Code’s requirement to adhere to the rules set out in the Wireless Code, in particular the requirement to provide data caps.
b) In the event Sasktel built the functionality for data caps into its legacy billing system, would these capabilities be implemented before the Code’s 2 December 2013 implementation date?

3) Commission staff notes that accelerating the timeline for rollout of Sasktel’s new billing system was not addressed in its application. Please comment on this possibility and include a description and estimate of the additional costs, if any, this would entail.
