RE: Tariff Notice 33 – Port out cancellation charge
Dear Madam:
On July 19, 2013, Eastlink filed a letter requesting to withdraw the above-noted application from consideration by the Commission. Eastlink submitted that it was not aware that Bell Canada had a port-out cancellation tariff in place subsequent to the release of Telecom Decision 2013-166 and, consequently, Eastlink has filed its proposal to reference Telus’ port-out cancellation tariff instead.
Commission staff notes that in separate correspondence, Bell Aliant Regional Communications, Limited Partnership (Bell Aliant) stated that it inadvertently did not update its tariff website to reference the port-out cancellation tariff subsequent to Telecom Decision 2013-166, but that it has now done so.
Given the fact that Eastlink’s tariff already includes the appropriate references to Bell Aliant’s and Bell Canada’s tariff, Commission staff considers that no changes to Eastlink’s tariff are required.
Therefore, Eastlink’s request to withdraw this application is accepted. The public file for this application is therefore closed.
