RE: Wireless Code – Requests for Clarification

Dear Sirs,

The Commission has received your requests for clarification of certain aspects of Telecom Regulatory Policy CRTC 2013-271. As set out in paragraph 379, parties may seek guidance or interpretation on any part of the Wireless Code. Upon review, staff considers that a Commission response, rather than a Commission staff response, is appropriate.

In light of the Code’s importance to wireless service providers and their customers and the significance of any Commission decision on interpretation of the Code, formal applications are necessary. As such, your requests should be filed as applications pursuant to Part 1 of the CRTC Rules of Practice and Procedure (the Rules). Pursuant to the Rules, your applications will be posted on the Commission’s website in order to ensure that Canadian consumers and other persons are able to fully participate in any process which could impact the implementation of this important consumer initiative. The Commission may choose to vary the Rules in order to ensure that these applications are treated in a comprehensive and timely fashion.

As noted in your letters, responses to these questions of clarification are necessary to ensure timely implementation of the Code. Therefore, I suggest that your applications be filed as soon as possible.
