RE: Request to implement Wireless Number Portability in Wightman’s serving territory

Dear Sirs:

Commission staff is in receipt of several letters of correspondence between Rogers Communications Partnership (RCP) and Wightman Communications Ltd (Wightman) concerning a request made by RCP for Wightman to implement wireless number portability (WNP) in three exchanges within its serving territory.

Commission staff notes that there is disagreement between the parties over whether RCP must establish a direct interconnection arrangement with Wightman in order for WNP to be implemented. RCP has indicated that a direct interconnection with Wightman is not necessary under the circumstances and wishes to negotiate an alternate interconnection arrangement. Absent a direct interconnection with RCP, Wightman has declined to implement RCP’s request for WNP.

Commission staff notes that in Telecom Regulatory Policy 2012-24 the Commission determined that implementation of WNP in a small ILEC’s operating territory is conditional on the wireless carrier directly interconnecting with the small ILEC, unless otherwise negotiated. Commission staff also notes that Telecom Regulatory Policy 2012-24 does not place any obligation on small ILECs to negotiate alternate interconnection arrangements with wireless carriers.
