RE: Brooke Telecom Tariff Notice 16 – Revisions to General Tariff reflecting determinations made in TRP CRTC 2013-160

Dear Sir,

On 6 May 2013, the Commission received an application by Brooke Telecom Co-operative Ltd. (Brooke Telecom) under Tariff Notice 16, dated 30 April 2013, in which the company proposed revisions to its General Tariff Section 100, item 4 – Rate schedules for primary exchange (local) service. The company certified that its application is a Group B filing and proposed an effective date of 15 May 2013.

Commission staff notes that, pursuant to Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010, as amended from time to time (Information Bulletin 2010-455), Group B tariff filings must be filed with the Commission at least 15 calendar days before the proposed effective date.

Therefore, Brooke Telecom should have requested an effective date that is no earlier than 21 May 2013. For efficiency, the Commission will process this application as a Group B tariff filing with an effective date of 21 May 2013, rather than close the file and require the company to re-file it as a new application.
