RE: Agreements 1652/00, 1654/00, 1655/00, and 1656/00 – Xittel/Vidéotron MALIs
Dear Mr. Leduc:
On 13 March 2013, the Commission received applications by Telecommunication Xittel Inc. (Xittel), under Agreement Numbers 1652/00, 1654/00, 1655/00, and 1656/00, all of them standard master agreements for local interconnection (MALI) between Xittel and Vidéotron.
Commission staff notes that paragraph 22(2) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules of Procedure) sets out the information that applicants must include in their applications and that paragraph 59 of the Rules of Procedure specifies the procedural requirements established for the approval of a tariff or an agreement. Paragraph 8 of the Rules of Procedure provides that the Commission may return an application or close a file that does not meet these requirements.
Commission staff also notes that pursuant to Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010, as amended from time to time (Information Bulletin 2010-455), the applicant is not required to file MALIs which are identical to Commission-approved models.
Staff notes that Xittel’s applications conform to the Commission’s MALI model.
There is no need for Xittel to resubmit these applications, however Commission staff notes that paragraph 31 of Information Bulletin 2010-455 states in part that:
“LECs must continue to file Carrier Services Group agreements, other transiting agreements, Schedule C to MALIs, and non-standard LEC-IXC agreements and MALIs within seven business days of their execution.”
Thus, should Xittel enter into a non-standard MALI or Schedule C to a MALI, it must submit it to the Commission.
