RE: Tariff Notice 27 – Local network interconnection and component unbundling

Dear Sir,

On 7 March 2013, the Commission received amended tariff pages for the above-mentioned tariff notice by Wightman Telecom Ltd. (Wightman). Wightman indicated that it submitted the tariff pages in compliance with Wightman Telecom Ltd. – Local network interconnection and component unbundling, Telecom Order 2012-48, 24 January 2012 (Telecom Order 2012-48).

Commission staff notes that in Telecom Order 2012-48, the Commission approved Tariff Notice 27, effective the date of the order, with modifications set out in the appendix to the order. Further, the Commission directed Wightman to file an amended copy of its tariff pages, reflecting the modifications described in the appendix of the order, within 15 days of the date of the order.

Staff has reviewed the amended tariff pages and notes that they do not accurately reflect the modifications set out in the appendix to the order as follows:

i. On page 7 of the amended tariff pages, the company has retained a portion of the paragraph titled “Connection to inside wire”, rather than removing the paragraph completely as specified in the appendix to the order.
ii. The company has removed completely the section titled “Rates and Charges” in the amended pages, rather than only the portion of the original proposed tariff pages as specified in the appendix to the order.

Commission staff also notes that Wightman submitted its amended tariff pages more than a year after the date of the order rather than within 15 days of the date of the order.

Wightman is to file amended tariff pages that comply with Telecom Order 2012-48 within 5 business days of the date of this letter.
