Re: Wireless Code Proceeding (NoC 2012-557-5) – Procedural request regarding late submission by CIPPIC

Dear Mr. Israel,

The Commission is in receipt of a procedural request regarding a late submission by the Samuelson-Glushko Canadian Internet Policy & Public Interest Clinic (CIPPIC) related to the Proceeding to establish a mandatory code for mobile wireless services.

In Telecom Notice of Consultation 2012-557-4, the Commission revised the schedule for the hearing as follows:

Following the public hearing, interveners may file final written comments on the working document, submissions made on the online consultation, and submissions made during the oral hearing by 1 March 2013. Interveners may file final written replies, responding to submissions made in final written comments, by 15 March 2013. Final written replies are not to exceed 15 pages (including an executive summary).

CIPPIC requested that the Commission accept its final written comments, which it submitted late (6 March 2013), and served on other parties (8 March 2013).

CIPPIC submitted that it was unable to file its final written comments within the specified time frame, but that it would be fair and in the public interest for the Commission to add its submission to the public record of the proceeding.

The Commission notes that CIPPIC filed its final written comments jointly with the Open Media Engagement Network, and that both organizations represent consumer interests.

The Commission has reviewed CIPPIC’s submission and considers that it includes new, unique, and relevant arguments that would contribute to the proceeding. The Commission notes that it has taken significant steps to facilitate consumer and consumer advocacy participation in this proceeding and considers that the public interest favours adding this submission to the public record.

For these reasons, the Commission considers that, in this case, it is appropriate to accept CIPPIC’s submission, even though it was filed late.

Given that the deadline to reply to the final written comments is 15 March 2013, the Commission will provide parties an additional 5 business days to comment on only any new issues raised in CIPPIC’s final written comments. The original reply date will remain for commenting on all other issues and submissions. These amendments are set out in the amended Notice of Consultation for this proceeding, Telecom Notice of Consultation CRTC 2012-557-5, 13 March 2013.

In the interest of fairness to all parties, the Commission emphasizes the need for parties to file their submissions on time, or, if parties consider that they will require additional time to make their submissions, to file procedural requests seeking extensions in advance of deadlines.

A copy of this letter and all related correspondence will be added to the public record of the proceeding.
