Re: Appointment of an Inquiry Officer to review matters related to 9-1-1, Telecom Notice of Consultation CRTC 2012-686, 17 December 2012 (TNC 2012-686)
Dear Madam, Sir:
The Commission is in receipt of a letter dated 11 January 2013 from the Public Interest Advocacy Centre (PIAC) regarding a request that the Commission convert the TNC 2012-686 inquiry into a public proceeding in order to allow public interest and accessibility groups to apply for intervener costs. PIAC states that it was informed that the inquiry is not considered a proceeding for the purposes of intervener costs rules and that in the absence of intervener costs, public interest and accessibility groups will be effectively barred from participating in the inquiry.
The Commission is also in receipt of letters dated 14 January 2013 from TELUS Communications Company, 16 January 2013 from Bell Canada, and 16 January 2013 from MTS Inc. and Allstream Inc., in which these companies stated their support for PIAC’s participation in the inquiry.
Commission staff has considered PIAC’s request and in particular its submission on the meaning of the term “proceeding”. In Commission staff’s view, PIAC is correct that the TNC 2012-686 inquiry should be considered a “proceeding” under the Telecommunications Act. As such, Commission staff considers that it is open to parties to apply to the Commission for intervener costs for their participation in the public comment phase of the TNC 2012-686 inquiry in accordance with the Commission’s normal guidelines for intervener costs https://crtc.gc.ca/eng/archive/2010/2010-963.htm).
In light of this conclusion, Commission staff considers that PIAC’s request to convert the TNC 2012 686 inquiry into a Commission proceeding does not need to be addressed.
