RE: Part 1 application by MTS Allstream – Wholesale access services

Dear Ms. Griffin-Muir:

The Commission is in receipt of the above noted Part 1 application from Allstream Inc. (MTS Allstream), dated 8 January 2013, concerning the upcoming forbearance of certain wholesale services provided by Bell Aliant Regional Communications, Limited Partnership and Bell Canada (the Bell Companies), which will occur on 3 March 2013 pursuant to the phase-out schedule established in Telecom Decision 2008-17. 1

In its application, MTS Allstream indicated that on 3 January 2013 it received a proposal from the Bell Companies outlining the new pricing, terms and conditions for certain wholesale services being forborne pursuant to Telecom Decision 2008-17. Following receipt of this proposal, MTS Allstream requested the Commission:

(1) Require that wholesale facilities and services leased from the Bell Companies be available for resale, other than simple resale, irrespective of whether the service in question is forborne or continues to be regulated.
(2) Grandfather the current Competitor Digital Network (CDN) wholesale tariffed rates for those DS-1 intra-exchange channels between the Bell Companies central offices (COs) that are being migrated pursuant to MTS Allstream’s 2 March 2012 request, until such time as the Bell Companies have completed the migrations; and
(3) Grandfather rates for in-service CDN DS-3 access services at least until the planned review of the essential services policy has been completed.

MTS Allstream also requested that the Commission move forward to 2013 the Review of Essential Services Policy, currently identified on the Commission’s three-year plan for 2014-2015.

In addition, MTS Allstream requested that its application be treated on an expedited basis given the upcoming 3 March 2013 phase-out date, and proposed deadlines of 14 January 2013 for parties to file comments on the application, and 17 January 2013 for MTS Allstream to file its reply comments. MTS Allstream also requested that the Commission consider at least the relief regarding resale of wholesale services on an expedited basis and render a decision on this matter by the beginning of February 2013.

In light of the circumstances, Commission staff is of the view that it is appropriate to conduct an expedited process for MTS Allstream’s application. Interested persons may file comments on MTS Allstream’s application no later than 21 January 2013. MTS Allstream may file reply comments no later than 24 January 2013.
