Mr. Thompson,

This is further to your letter of November 7, 2013 requesting that the Commission establish an opportunity for interveners in the above-noted proceeding to file final written comments.

No right to file final written comments is provided for in The Rules of Practice and Procedure (the Rules); however, the Commission retains the discretion to alter the Rules or provide additional process if it is of the opinion that considerations of public interest or fairness warrant it.

In the present case, the Commission acknowledges your concerns regarding the additional information pertaining to viewership numbers which Corus undertook to provide in response to the Commission’s questions at the hearing. Nevertheless, the Commission is satisfied that the information on the public record of this proceeding is sufficient for it to make a finding on the issue and considers that no additional benefit will be obtained by further process.

Accordingly, the Commission denies your request for an opportunity for interveners to file final written comments.
