Pursuant to Section 33(4) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules), the Commission requests public disclosure of the following information that you designated as confidential with respect to the above-noted proceeding:

• Financial projections for CKYE-FM (if licensed for a repeater, and should all of the four applications be denied) and their abridged version.

The Commission notes your rational provided in your letter dated 17 June 2013 to explain why the Commission should not disclose this information. The Commission notes that it generally does not grant confidentiality on financial projections and requires this information as set out in question 6.3 of the application form:

(6.3) “Please provide three years of financial projections (revenues and expenses), with and without approval of the proposed amendment(s) for commercial radio.”

Additionally, the appendix to Broadcasting and Telecom Information Bulletin CRTC 2010-961, Procedures for filing confidential, information and requesting its disclosure in Commission proceedings, Disclosure Guidelines, clearly indicates that projections (financial statements and assumptions) for projections years in the prospective licence term for amendment applications are public.

In response to this request for disclosure, South Asian Broadcasting Corporation Inc. must either 1) file a revised public version of the document reflecting the determinations above or 2) file a reply to the Commission’s request for disclosure by no later than by 25 October 2013.

The Commission requires that you submit your documents electronically using the secured service “My CRTC Account” (Partner Log In or GCKey) and fill in the “Broadcasting and Telecom Cover page” located on this web page. On this web page, you will also find a link to information on the submission of applications to the Commission “Submitting applications and other documents to the CRTC using My CRTC Account.”

A copy of this letter and all related correspondence will be added to the public record of the proceeding.
