Dear Mr. Atkinson,

Section 28(1)(a) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that the Commission may request parties to file information, particulars or documents where needed. In order to proceed with your application, please address the following:

Annual Returns

1. Pursuant to section 9(2) of the Radio Regulations, 1986, (the Regulations), licensees are required to file, no later than 30 November of each year, their annual return for the broadcast year ending the previous 31 August. Failure to file these returns, in whole or in part, by the required date of 30 November of each year, may result in an apparent non-compliance.

According to Commission records, the annual return for the 2007-2008, 2008-2009, and 2009-2010 broadcast years were filed late. More specifically:

Therefore, it appears that CJSW‐FM may be in a situation of apparent non‐compliance with section 9(2) of the Regulations, relating to the filing of annual returns for the above noted broadcast years.

In light of the information above:

a) Please explain the circumstances of this apparent non‐compliance.

b) Please specify what measures/plans have been or will be put in place to ensure future compliance with section 9(2) of the Regulations.

c) Please provide your plans so as to ensure full compliance with the Regulations during the current licence term.

d) Please comment on the possibility of a denial of your technical amendment application for CJSW-FM, in accordance with Broadcasting Information Bulletin CRTC 2011-347, should you be found in non-compliance with section 9(2) of the Regulations.
