Re: Telus Communications Company (“Telus”)’ compliance report with respect to the loudness of TV commercial messages

Dear Mr. Woodhead:

This is a follow-up to Commission staff’s letter dated 18 June 2013, requesting that Telus provide specific information regarding its compliance report with respect to the loudness of TV commercial messages.

Commission staff is in receipt of Telus’ response to the aforementioned request, dated 28 June 2013.

After reviewing your latest response, as well as the previous information filed, Commission staff is satisfied with the information provided by Telus pursuant to paragraph 25 of the Broadcasting Information Bulletin CRTC 2012-471 and specifically regarding the steps undertaken by Telus to ensure that any US programming it distributes is compliant with the ATSC Recommended Practice A/85. Accordingly, based upon Telus’ statements and attestation letters provided, Commission staff considers that, at this time, no further measures are required.

Consequently, the examination of Telus’ compliance report has concluded and we thank you for your collaboration during this initial compliance assessment. Note that this does not preclude Commission staff from requesting compliance reports or additional information in the future.

Sincerely,

Lynne Perrault
Acting Chief Compliance and Enforcement Officer
