Dear Ms. Kong:

This is in reference to your procedural request to add a document that was submitted to the Commission on 20 March 2013 to your written intervention on the public file for EqualiTV’s application for mandatory carriage on digital basic. Subsequently, Ms. Sheila Richardson, as a representative of the applicant, EqualiTV, has sent a number of email responses to your request to add a document to the public file.

The Commission notes that the intervention period closed as of 27 February 2013 and that you have asked to appear at the upcoming 23 April public hearing. With these considerations in mind, the Commission considers it inappropriate to include your submission as part of the intervention process at this time. As a result, the email responses sent by Ms. Richardson will also not be added to the public file at the present time.

Nevertheless, your request to appear during the intervention phase of the hearing is being granted, and, although procedurally irregular, you may request documents to be added to the public file during your appearance. Any procedural request must be explained and justified by the requestor. Subsequent to your appearance, the applicant will have an opportunity to reply to the intervention (including any documents accepted by the Hearing Panel) during the applicant’s appearance during oral reply phase of the public hearing.

It is to be noted that you have requested that your appearance at the hearing be done via video conference. Should you have any questions as to how to present your intervention at the hearing, please contact the Hearing Secretary, Lynda Roy at 819-953-4009 or via email at Lynda.roy@crtc.gc.ca.

A copy of this letter will be added to the public record of the proceeding.
