Re: Application for mandatory distribution of ARTV as part of the digital service of terrestrial broadcasting distribution undertakings in English-language markets, Broadcasting Notice of Consultation CRTC 2011-379 and 2013-19

Dear Interveners :

This is further to an intervention that you submitted in the context of the public hearing on the licence renewals for the Canadian Broadcasting Corporation’s (the CBC’s) French- and English-language services, Broadcasting Notice of Consultation CRTC 2011-379, in regard to the national French language Category A specialty service, ARTV.

During the hearing held to examine CBC’s licence renewal, ARTV clarified that it was requesting mandatory distribution of its service pursuant to section 9(1)(h) of the Broadcasting Act (the Act). As a result, the Commission has decided that it will not consider ARTV’s application for mandatory distribution in the context of CBC’s licence renewal process. That part of ARTV’s application will be considered during the hearing that will examine applications for mandatory distribution and applications for the licence renewals of independent conventional, pay and specialty television services. All other aspects of ARTV’s renewal application will be considered in the context of CBC’s licence renewal process.

We expect that ARTV will file its revised application for mandatory distribution by 31 January 2013 and that the application will be available on the Commission’s website shortly thereafter. Parties are invited to submit their revised interventions pursuant to Broadcasting Notice of Consultation CRTC 2013-19, which has been issued today.
