Re: [Follow-up on] 8 Complaints regarding the loudness of TV commercial messages during the NFL Football Game program broadcasted on 9 September 2012 (from 1:00 P.M. to 6:30 P.M.) on City-TV channel (CRTC case ID # 590027, 590033, 590035, 590036, 590038, 590039, 590040 and 590306); The Broadcasting Regulatory Policy CRTC 2012-273 (“the regulatory requirements”)

Dear Ms. Wheeler:

Following a number of complaints regarding the inconsistency in loudness of audio between programming and commercial messages, we sent you a request on 28 November 2012 asking for confirmation that the company was compliant with the regulatory requirements. We also asked you to provide us with a description of the corrective measures taken to reduce the risk of future non-compliance.

We thank you for your reply received on 12 December 2012. Following an analysis of the documents you submitted to us, we are satisfied with your response and accordingly, consider the above-mentioned file closed.

The staff of the Canadian Radio-television and Telecommunications Commission will continue to ensure compliance with the regulatory requirements in order to address concerns expressed by Canadian consumers with respect to the loudness of commercial messages.
