Various commercial radio programming undertakings – Licence renewals
1. Harvard Broadcasting Inc. (Harvard) filed applications to renew the broadcasting licences for the commercial radio stations set out in Appendix 1 to this decision, which expire 31 December 2013.[1] The Commission did not receive any interventions regarding these applications.
Previous non-compliance
2. In Broadcasting Decision 2010-438, the Commission renewed CKRM Regina’s licence for a short-term period of three years, given the station’s non-compliance with section 9(2) of the Radio Regulations, 1986 (the Regulations) relating to the filing of annual returns for each of the 2006-2007 and 2007-2008 broadcast years, with the Regulations as they relate to the broadcast of content category 2 (Popular Music) musical selections and with its conditions of licence relating to Canadian talent development contributions for the 2007-2008 broadcast year.
3. Moreover, in Broadcasting Decision 2010-439, the Commission renewed CHMX-FM Regina’s licence for a short-term period of three years since the station was found in non-compliance with section 9(2) of the Regulations regarding the filing of annual returns for each of the 2006-2007 and 2007-2008 broadcast years.
4. The Commission notes that the non-compliance issues for each station have been resolved. In addition, the Commission notes that in the last licence term,[2] the licensee was in compliance with its regulatory requirements for each station. Given the circumstances surrounding Harvard’s non-compliance for the above-mentioned stations, the Commission finds it appropriate to grant these stations a full-term licence renewal.
Conclusion
5. In light of all of the above, the Commission renews the broadcasting licences for the commercial radio programming undertakings set out in Appendix 1 to this decision from 1 January 2014 to 31 August 2020. The conditions of licence for each station are set out in the appropriate appendices.
Reminder
6. Pursuant to section 22 of the Broadcasting Act, the Commission reminds the licensee that the broadcasting licences will cease to have any force or effect if the broadcasting certificates issued by the Department of Industry lapse.
Employment equity
7. Because the licensee is subject to the Employment Equity Act and files reports concerning employment equity with the Department of Human Resources and Skills Development, its employment equity practices are not examined by the Commission.

Terms and conditions of licence for the commercial radio programming undertaking CFEX-FM Calgary, Alberta
Terms
The licence will expire 31 August 2020.
Conditions of licence
1. The licensee shall adhere to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009, as amended from time to time.
2. The licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986 (the Regulations), in any broadcast week:
(a) devote, in that broadcast week, a minimum of 40% of its musical selections from content category 2 (Popular Music) to Canadian selections broadcast in their entirety; and
(b) devote, between 6 a.m. and 6 p.m. in the period from Monday to Friday of the same broadcast week, 40% or more of its musical selections from content category 2 to Canadian selections broadcast in their entirety.
For the purposes of this condition, the terms “broadcast week,” “Canadian selection,” “content category,” and “musical selection” shall have the meanings set out in the Regulations.

Conditions of licence

Appendix 4 to Broadcasting Decision CRTC 2013-686
Terms and conditions of licence for the commercial radio programming undertaking CFVR-FM Fort McMurray, Alberta
Terms
The licence will expire 31 August 2020.
Conditions of licence
1. The licensee shall adhere to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009, as amended from time to time.
2. As an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986 (the Regulations), the licensee shall devote, in each broadcast week:
a) at least 40% of its musical selections from content category 2 (Popular Music) to Canadian selections broadcast in their entirety; and
b) between 6 a.m. and 6 p.m. in the period from Monday to Friday, 40% or more of its musical selections from content category 2 to Canadian selections broadcast in their entirety.
For the purposes of this condition, “broadcast week,” “Canadian selection,” “content category” and “musical selection” shall have the meanings set out in the Regulations.
3. The licensee shall, with the support of the Aboriginal Peoples Television Network, train at least one person from the local Aboriginal community in news reporting during each year of the licence term.
4. To fulfill its original obligation to Canadian content development (CCD) set out in Adult Contemporary FM radio station in Fort McMurray, Broadcasting Decision CRTC 2006-627, 15 November 2006, the licensee shall, in addition to the contributions to CCD required under section 15(2) of the Radio Regulations, 1986, as amended from time to time, contribute $150,000 in the 2013-2014 broadcast year to an eligible CCD initiative as described in paragraph 108 of Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006, as amended from time to time.

Terms
The licence will expire 31 August 2020.
Conditions of licence
1. The licensee shall adhere to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009, as amended from time to time.
2. As an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986 (the Regulations), the licensee shall devote, in each broadcast week:
