Applications processed pursuant to streamlined procedures

The Commission sets out lists of applications that did not require a public process and that it processed from 1 September to 31 December 2012 pursuant to its streamlined procedures. These applications involve transfers of ownership and changes in the effective control of broadcasting undertakings, as well as applications for amendments or extensions of deadlines.

1. The Commission has streamlined procedures for its consideration of applications that involve transfers of ownership and changes in the effective control of broadcasting undertakings, amendments or extensions of deadlines and that do not require a public process.1 Under these procedures and on a case-by-case basis, the Commission may approve or deny such an application without first having issued a notice of consultation provided that:

a) its examination of the application reveals no significant policy concern; and

b) the Commission is convinced that approval or denial would be consistent with its approvals or denials of previous applications.

2. Where these two conditions are met, the Commission is generally satisfied that a process initiated by a notice of consultation is not required in the public interest and would unnecessarily delay implementation of the transaction contemplated or other proposals by the applicant.

3. In the appendices to this information bulletin, the Commission has set out lists of applications that did not require a public process and that it processed from 1 September to 31 December 2012 pursuant to its streamlined procedures. The list of applications involving transfers of ownership and changes in the effective control of broadcasting undertakings is set out in Appendix 1. The list of applications involving amendments or extensions of deadlines is set out in Appendix 2.

Atkey as trustee and transfer to Atkey of the control of the partnership unit held by Entertainment One Television BAP Ltd. in The Canadian Documentary Channel Limited Partnership (Documentary LP). This transaction does not affect the effective control of the undertaking, which continues to be exercised by the Canadian Broadcasting Corporation.

Documentary LP is licensee of the specialty service Documentary.
3. Sortir FM inc. 2012-0845-5

5 September 2012		 APPROVED – Corporate reorganization for the purpose of amalgamating Sortir FM inc. with its parent company Mass-Média Capitale inc. and Les Consultants Net-Création inc. to continue under the name of Mass-Média Capitale inc.

This transaction does not affect the effective control of the undertakings, which continues to be exercised by Louis Massicote.

Sortir FM inc. is licensee of the radio programming undertakings CKJF-FM and CJNG-FM Québec, Quebec.
4. Westwave Broadcasting Inc. 2012-0828-1

7 September 2012		 APPROVED – Change to the ownership and effective control of Westwave Broadcasting Inc. (Westwave) through the transfer of all of the shares in the capital of Westwave to Vista Radio Ltd., a corporation controlled by Westerkirk Capital Inc.

Westwave is licensee of the radio programming CKAY-FM Sechelt, British Columbia.
5. Lighthouse Broadcasting Limited 2012-0971-8

26 September 2012		 APPROVED – Change to the ownership and effective control of Lighthouse Broadcasting Limited (Lighthouse) through the transfer of all of the shares in the capital of Lighthouse to Vista Radio Ltd., a corporation controlled by Westerkirk Capital Inc.

Lighthouse is licensee of the specialty radio programming undertaking CJLT-FM Medicine Hat, Alberta.
6. Radio Diffusion Sorel-Tracy inc. 2012-0815-8

2 October 2012		 APPROVED – Change to the ownership and effective control of Radio Diffusion Sorel-Tracy inc. from a control exercised by “Jean-Marc Belzile, Suzanne Bouchard and Nelson Sergerie” to a control exercised by “Jean-Marc Belzile, Suzanne Bouchard and Alexandre Belzile.”

Radio Diffusion Sorel-Tracy inc. is licensee of the radio programming undertaking CJSO-FM Sorel, Quebec.

12 October 2012		 APPROVED – Change to the ownership and effective control of Radio Saguenay inc. through the acquisition of all of the shares of Radio Saguenay inc. by Attraction Radio inc., a corporation controlled by Richard Speer.

Radio Saguenay inc. is licensee of the radio programming undertaking CKRS-FM Chicoutimi, Quebec.
8. Hollywood Suite Inc. (OBCI) (now incorporated under the name of Hollywood Suite Corp.) 2012-0865-3

29 October 2012		 APPROVED – Change to the ownership of Hollywood Suite Corp. as part of a corporate reorganization. This transaction does not affect the effective control of the licensee and its undertakings, which continues to be exercised by Jay Switzer.

Hollywood Suite Corp. is licensee of the specialty services AXN Movies and Sony Movie Channel.
9. Radiocorp Ltd. 2012-1158-1

19 November 2012		 APPROVED – Change to the ownership and effective control of Radiocorp Ltd. from a control exercised by James MacLeod to a control jointly exercised by Andrew Dickson and John Pole (My Broadcasting Corporation).

Radiocorp Ltd. is licensee of the radio programming undertaking CHCD-FM Simcoe, Ontario.
10. 8237646 Canada Inc. 2012-1215-9

27 November 2012		 APPROVED – Change to the effective control of 8237646 Canada Inc. (8237646) from a control exercised by John Sherrat to a control exercised by the three shareholders, Frank Torres, Edward Torres and John Sherrat, and change to the ownership of 8237646 as a result of the transfer of the shares of the shareholders in 8237646 to their respective family trusts.

8237646 received approval in English-language FM radio station in Uxbridge, Broadcasting Decision CRTC 2012-201, 3 April 2012, to operate a radio programming undertaking in Uxbridge, Ontario. This undertaking is not yet in operation.

27 November 2012		 APPROVED – Change to the ownership of 2345771 Ontario Inc. (2345771) resulting from a corporate reorganization.

This transaction does not affect the effective control of 2345771 and its undertaking, which continues to be exercised by Neeti P. Ray.

Grande Prairie Radio is licensee of the radio programming undertaking CJGY-FM Grande Prairie, Alberta.
15. World Fishing Network ULC 2012-1260-5

14 December 2012		 APPROVED – Change resulting from a corporate reorganization affecting the ownership of World Fishing Network ULC (WFN).

This transaction does not affect the effective control of the licensee and its undertaking, which continues to be exercised by Insight Sports Ltd, a corporation controlled by its board of directors.

WFN is licensee of the specialty service World Fishing Network.
16. The NHL Network Inc. 2012-1295-1

21 December 2012		 APPROVED – Change resulting from a corporate reorganization affecting the ownership of The NHL Network Inc. This transaction does not affect the effective control of the licensee and its undertaking, which continues to be exercised by the board of directors of 3918921 Canada Inc.

The NHL Network Inc. is licensee of the specialty service The NHL Network.
