Pursuant to section 72.07 of the Telecommunications Act, S.C. 1993, c. 38 (the Act), the undersigned has issued this notice of violation finding the Guelph Federal Liberal Association (the “GFLA”), on behalf of Mr. Frank Valeriote, to have committed the following violations contrary to the Canadian Radio-television and Telecommunications Commission’s (CRTC’s) Unsolicited Telecommunications Rules (the Rules) made under section 41 of the Act:
On April 30, 2011, unsolicited telecommunications were made by the GFLA to deliver an election advertising message on behalf of Mr. Frank Valeriote using an Automatic Dialing-Announcing Device (ADAD) resulting in violations of Part IV, subsections 4d) and 4e) of the Rules, for not providing the name, address and contact telephone number of the person on whose behalf the call was made in the messages and for not displaying the originating telephone number or an alternative contact telephone number.
Pursuant to section 72.01 of the Act, the undersigned has determined that the total penalty for the violations identified above is $4,900.
The penalty of $4,900 must be paid by the GFLA to "The Receiver General for Canada" in accordance with subsection 72.09(3) of the Act.
