Re: Tariff Notices 584 and 585 - Effective date
Dear Ms. Duguay:
On 23 November 2012, the Commission received an application by TELUS Communication Company (TCC) under Tariff Notices 584 and 585 (TN 584 and TN 585). The applications are of the competitor tariff type and the company proposed 21 December 2012 as the effective date in respect of both applications. The Commission reiterates that Telecom Information Bulletin CRTC 2010-455, Approval processes for tariff applications and intercarrier agreements, 5 July 2010, stipulates that tariff applications for competitor services must be filed with the Commission at least 30 calendar days before the proposed effective date, and that interested parties may file an intervention within 30 calendar days of the filing date of the application.
Staff also reiterates that the period beginning on 21 December in one year and ending on 7 January in the following year is not included in the computation of a time period, as stipulated in paragraph12(1)(c) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure.
Given that TCC filed its application on 23 November 2012 and that the period between 21 December and 7 January are not included in the computation of a time period, the thirtieth calendar day in the case of TN 584 and TN 585 falls on 9 January 2013. Therefore, the effective date for both requests cannot be earlier than 9 January 2013, and staff will process the applications taking 9 January 2013 to be the proposed effective date.
