RE: Part 1 Application for the recovery of local competition start-up costs

On 27 September 2012, Northwestel Inc. (Northwestel) submitted its response to requests for information by Commission staff regarding Northwestel’s Part 1 Application for the recovery of local competition start-up costs.

On 11 October 2012, the Commission received comments on Nortwestel’s response by the Public Interest Advocacy Centre and Consumers’ Association of Canada (collectively, PIAC/CAC). In its comments, among other things, PIAC/CAC requested that Northwestel disclose the information it filed in confidence.

On 18 October 2012, Nortwestel submitted reply comments. However, in its reply Northwestel did not address PIAC/CAC’s request for disclosure of the information filed in confidence.

Paragraph 28(1)(a) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that the Commission may request parties to file information or documents where needed.

Northwestel is requested to provide a complete response, with supporting rationale, to PIAC/CAC’s request for disclosure of the information filed in confidence, as well as comprehensive answers to the attached questions by 23 November 2012.

Commission staff notes that, when responding to PIAC/CAC’s request for disclosure of the information that Northwestel filed in confidence and to the attached questions, Northwestel should take into consideration the disclosure guidelines in Procedures for filing confidential information and requesting disclosure in Commission proceedings, Broadcasting and Telecom Information Bulletin 2010-961, 23 December 2010.

If appropriate, further process, allowing for comments by parties with respect to the additional information placed on the public record and reply comments by Northwestel, will be established at a later date.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date. Copies of the documents should also be sent to joseph.cabrera@crtc.gc.ca.
