RE:  Canadian Network Operators Consortium Inc. - Part 1 Application to Review and Vary Telecom Regulatory Policy 2011-703 and Telecom Regulatory Policy (TRP) CRTC 2011-704 - Filing date extension

The Commission is in receipt of a letter, dated 25 September 2012, from Bell Aliant Regional Communications, Limited Partnership and Bell Canada (collectively, the Bell companies) stating that they were unable to complete their responses to The Companies(CRTC)17Sep12-2 CNOC R&V TRP 2011-703, and The Companies(CRTC)17Sep12-4 CNOC R&V TRP 2011-703, and that the response to these requests will be filed by 27 September 2012. The Commission staff letter requested that the responses to these interrogatories be filed by 24 September 2012.

The Bell companies also indicated that they will not be able to file their updates, by
1st October 2012, to the monthly wholesale high-speed access services costs and other related wholesale costs, established in TRP 2011-703, that are affected by the errors identified in their 13 September 2012 submission. The Bell companies indicated that they will provide those updated costs by 5 October 2012.

Commission staff considers that the Bell companies request for an extension to the filing of their responses to Commission staff interrogatories can be accommodated, in part, in the circumstances. However, given the significant time extensions previously granted to the Bell companies in respect of related interrogatories that were issued on 13 July 2012, and the consequent delays to the process that have resulted, Commission staff is of the view that any further extensions would be unreasonable and would undermine the Commission’s important objective of arriving at a timely resolution of the various review and vary applications associated with TRP 2011-703. Accordingly, the remaining process dates, originally set out in the 13 July 2012 Commission staff letter, are revised as follows:

Parties are hereby advised that Commission staff is of the view that submissions filed outside of the process set out above will not form part of the record of the proceeding and therefore, will not be considered in the decision on the issues. Commission staff also advises that should the Bell companies fail to file their responses to the Commission staff interrogatories in accordance with these deadlines, the determinations that relate to these responses will be made based on the best information otherwise available.
