RE: Agreement 1512/00: Reminder regarding filing requirements
Dear Sir:
On 21 September 2012, the Commission received an application by Yak Communications (Canada) Corp. (Yak), specifically concerning Schedule C of the Master Agreement for Local Interconnection (MALI) between Yak and Fibernetics Corporation (Fibernetics).
At paragraph 46 of Forbearance with respect to certain inter-carrier agreements filed pursuant to section 29 of the Telecommunications Act, Telecom Decision CRTC 2007-129, 14 December 2007, the Commission determined, among other things, that local exchange carriers (LEC) are no longer required to obtain ex ante approval of Schedule Cs of MALIs, but that LECs must file these agreements within seven business days of their execution.
Commission staff notes that the agreement between Yak and Fibernetics was executed in August 2009, and therefore the above-mentioned application was filed approximately three years after the execution of the agreement. Commission staff reminds Yak that going forward it is expected that any Schedule Cs to MALIs will be filed with the Commission within the required timeframe.
